These Terms of Use (the "Terms") govern your use of the iPhone app "EmoCame" (the "App"). By downloading or using the App, you agree to these Terms.
We grant you a non-transferable, non-exclusive right to use the App for personal purposes, subject to these Terms and to Apple Inc.'s Licensed Application End User License Agreement (the "Standard EULA"). All copyright and other intellectual property rights in the App remain with us.
You may not copy, modify, reverse engineer, redistribute, or sell the App.
When using the App, you are solely responsible for:
We are not liable for any dispute or damage arising from these matters.
The App is provided "AS IS" and "AS AVAILABLE."
To the maximum extent permitted by applicable law, we make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or continued availability.
In particular, we do not warrant that:
To the maximum extent permitted by applicable law, we shall not be liable for any damages arising out of or in connection with the use of, or inability to use, the App — including but not limited to loss or corruption of photos or data, device malfunction, lost profits, lost business opportunities, or non-material damages, whether direct, indirect, incidental, special, or consequential — even if we have been advised of the possibility of such damages.
All payments, refunds, and purchase restoration for the App's in-app purchase ("EmoCame Pro") are handled by Apple Inc. through the App Store, subject to Apple's terms. Refund decisions are made by Apple; we have no ability to grant refunds.
We may change the App or discontinue providing it at any time without prior notice. Our liability for any resulting damages is subject to Section 4.
We may revise these Terms as needed. Revised Terms take effect when posted on this page.
These Terms are governed by and construed in accordance with the laws of Japan. Any dispute relating to the App or these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
However, if you are a consumer who, under the mandatory consumer protection laws of your country of residence, has the right to bring proceedings in the courts of that country, this Section does not restrict that right.
Apple Inc. is not a party to these Terms and has no responsibility for the App. Any questions, support requests, or claims regarding the App should be directed to us, not to Apple.
